WHITE SHELL TOURS – COMPREHENSIVE TERMS & CONDITIONS OF SALE
1. LEGAL ENTITY & ACCEPTANCE
1.1 Ownership: This website (the “Site”) is operated by White Shell Tours LTD, a company incorporated in Mauritius (BRN: C09060955), holding Tourist Enterprise License (TEL): 17382.
1.2 Agreement: By using this Site or purchasing any services, you enter into a legally binding contract. If you do not agree to these terms, you must cease use immediately.
1.3 Amendments: We reserve the right to modify these terms at any time. The version live at the time of your booking shall apply.
2. PRODUCT PRICING & ACCURACY
2.1 Dynamic Pricing: Prices are quoted in Euros (€). We reserve the right to change prices without notice; however, once a booking is confirmed, the price is guaranteed.
2.2 Visuals & Descriptions: Photos of vehicles, flora, and fauna are for illustrative purposes. While we strive for consistency, we do not guarantee the exact visual match of nature or third-party vehicle models.
2.3 Technical Errors: In the event of a “glitch” or “manifest error” where a tour is priced significantly below market value (e.g., €0.01), we reserve the right to cancel the booking and offer a full refund.
3. BOOKING VOUCHERS & REDEMPTION
3.1 The Voucher: Your booking is only valid upon presentation of a digital or printed White Shell Tours Voucher.
3.2 Identification: The Lead Traveler must present a valid ID (Passport or National ID) matching the name on the voucher.
3.3 The “Island-Wide” Pickup: We provide free transfers for tours. However, it is the Client’s responsibility to provide the correct hotel name/address. We are not responsible for missed departures due to incorrect location data provided by the user.
4. Pickup and Transfer Policy
4.1. Full-Day Tours: We offer Free Island-Wide Pickup for all full-day private tours booked through White Shell Tours.
4.2. Individual Activities: For bookings of standalone activities (e.g., separate boat trips or park entries without a full-day tour), a surcharge will apply for transfers.
4.3. Clients must be ready at the designated pickup point (Hotel Reception or Villa Entrance) at the time stated on the voucher. Our drivers will wait for a maximum of 1 hour. Failure to arrive on time may result in the tour being cancelled as a “No-Show” without a refund.
5. CANCELLATION, AMENDMENTS & REFUNDS
5.1 Client-Initiated Cancellation:
7+ Days: 95% Refund (5% retained as administrative/gateway fees).
3–7 Days: 50% Refund.
Less than 48 Hours / No-Show: 0% Refund.
4.2 Amendments: Requesting a date change is subject to availability. Changes made less than 72 hours before the tour may incur a €20 administrative fee.
4.3 No-Show: If you are not at the reception/pickup point at the scheduled time, the driver will wait for 60 minutes and then depart. This is considered a “No-Show” and is non-refundable.
6. CLIENT RESPONSIBILITY & BEHAVIOR
6.1 Code of Conduct: We reserve the right to terminate service immediately if a client is aggressive, intoxicated, or puts the driver/vehicle at risk. No refund will be issued.
6.2 Health & Fitness: Certain activities (hiking/snorkeling) require physical fitness. It is your responsibility to ensure you are medically fit.
6.3 Underage Travelers: Minors must be accompanied by an adult at all times.
7. THIRD-PARTY SUPPLIERS & LIABILITY
7.1 Agency Role: For specific activities (e.g., Catamaran cruises, Rhumerie tours), White Shell Tours acts as an agent. While we vet our partners, the supplier’s own terms and conditions also apply to those specific segments.
7.2 Limitation of Liability: To the maximum extent permitted by Mauritian law, White Shell Tours shall not be liable for any indirect, incidental, or consequential damages (e.g., missing a flight because of traffic during a tour).
8. FORCE MAJEURE (STRIKES, WEATHER, ACTS OF GOD)
8.1 Scope: Neither party is liable for failure to perform due to events beyond their control: Cyclones (Class II+), Torrential Rain warnings, flash floods, strikes, or government-imposed lockdowns.
8.2 Resolution: In such cases, the priority is Rescheduling. If the client is leaving the island and cannot reschedule, a refund (minus 5% gateway fee) will be issued.
9. INTELLECTUAL PROPERTY & SITE USE
9.1 Content Ownership: All text, custom code (Tourfic/WP), and curated images on this site are the property of White Shell Tours. Scraping or copying our unique itineraries for commercial use is strictly prohibited.
9.2 Security: Any attempt to bypass the payment gateway or inject malicious code will be reported to the Mauritius Cybercrime Unit.
10. COMPLAINTS & DISPUTE RESOLUTION
10.1 Immediate Reporting: If there is an issue during the tour, you must call our hotline immediately so we can resolve it in real-time. We will not accept claims for refunds made after the tour has ended if the issue was not reported during the trip.
10.2 Jurisdiction: This contract is governed by the laws of the Republic of Mauritius.
11. Liabilities and Disclaimers
11.1. Personal Property: We are not responsible for the loss, theft, or damage of personal belongings left in the vehicle or at any tour site.
11.2. Safety: Clients must adhere to all safety briefings and local laws. White Shell Tours is not liable for injuries resulting from a Client’s failure to follow safety instructions or during activities provided by third-party suppliers (e.g., boat operators).
7.3. Itinerary Changes: We reserve the right to modify the sequence of stops or skip certain locations due to road closures, traffic, or unforeseen events.
12. Privacy and Data Protection
12.1. We collect and process your personal data in accordance with the Mauritius Data Protection Act 2017. Your data is used solely for the fulfillment of your booking and will never be sold to third parties.
13. Governing Law
13.1. These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Mauritius. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the Mauritian courts.
